Release Agreement May Not Bar Later Discrimination Claims

Butler v. Vons Companies, Inc., 140 Cal. App. 4th 943 (2006)
While working as a stock clerk for Vons, Butler signed a release agreement arising from an altercation that he had with his manager. Two years later, Butler filed unrelated claims of employment discrimination against Vons. Butler?s employer then tried to use the release to bar his discrimination claims. The trial court granted Vons? motion for summary judgment, but the Court of Appeal reversed, holding that the scope of the waiver contained in the release was ambiguous and as such presented a triable issue.
