Wage and Hour Settlement Vacated Because of Insufficient Discovery 15-April-2009 A settlement involving approximately 18,000 Foot Locker employees who were required to “purchase and wear shoes of a distinctive design or color as a term of their employment,” as well as employees who were subject to security searches for which they were not compensated, was recently vacated after a former employee filed a separate class action lawsuit and challenged the adequacy of the settlement. The court of appeal reversed the judgment approving settlement, stating that there was insufficient investigation and discovery prior to settlement, thus rendering the lower court unable to ensure the terms of the settlement were fair, adequate and reasonable. |
